Should you die without a will - the "state" determines who your beneficiares are.
In NH -- half goes to your spouse, half to your children. The number one mistake in estate planning. is "Not" doing it.
Howard Hughes is a classic example. He died without a will and his estate
was in probate court for over 15 years.

There are pitfalls like Federal EstateTax. Here's what Attorney Sally Mulhern has to say:
SALLY MULHERN: We're in NH live free or die. I say live free die cheap. And each of our borders is MA and ME and each of those states has imposed state death tax. And, so, if clients own real estate in either one of those states or any other state in the US that has a state death tax you can trigger tax actually on the first death which surprises a lot of clients. It's a long list of potential issues.
So, how do you MINIMIZE your Exposure to FEDERAL & State Estate taxes?
** so, How do you pass along your wealth without the GOVT taking it first.

What about Nursing Home Insurance -- should that be included in your
estate plan. Sally Mulhern says Absolutely.
Particularly in NH its becoming increasingly difficult to qualify for Medicaid and a lot of clients confuse Medicare and Medicaid, Medicaid is the welfare program that pays for nursing home costs. Historically and currently there was a three year look back so if you went to apply for Medicaid one of the questions asked is have you given any assets away in the prior three years because what the state doesn't want to see happen is people give there assets away and throw themselves on the doorstep of the state saying now im impoverished you have to pay for my nursing home care.
Mulvern says the truly indigent automatically qualify for Medicare.
the truly wealthy that can afford to self- pay. The rest of us need coverage
so as to avoid losing our entire nest-eggs.
Q State looking for a 5-year lookback period.
Want to make it more difficult to qualify for Medicaid.
You may not have an estate to plan -- if your money has been
eroded paying for nursing health care.
